1. Acceptance of Terms. By accessing or using the Tidewell services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
2. User Obligations. You agree to provide accurate, current, and complete information during the registration process. However, considering the anonymous nature of our service, "accurate" is defined subjectively by the user's digital persona intent pursuant to Section 4.b of the Privacy Charter.
3. Limitations of Liability. In no event shall Tidewell, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.
4. Data Retention. Tidewell adheres to a strict "volatile memory" protocol. We reserve the right to purge data at any moment for security compliance. Users are solely responsible for local backups.
5. Governing Law. These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
6. Termination. We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
